HB 3741 - a new Data Privacy Omnibus bill

March 11, 2021:  Rep. Giovanni Capriglione filed HB 3741, a Data Privacy Omnibus bill that has been described as a “heavily modified version of the CCPA.”  If passed, the bill would provide Texas residents with the rights to:

  • know
  • correct inaccurate information
  • access
  • data portability
  • deletion

ENFORCEMENT:  Texas Attorney General’s office

PENALTY:  a civil penalty in an amount of not more than $10,000 for each violation, not to exceed a total of $1 million

With House Bill 4518 left in committee, Texas Governor Greg Abbot signed House Bill 4390 into law shortly thereafter, thus establishing the Texas Privacy Protection Advisory Council.
